These Terms and Conditions (“Terms”) govern your access to and use of the Fit Store website at https://myfitstore.net (the “Website”) and any purchase of products through it. The Website is operated by Fitstore Ltd (“Fitstore,” “we,” “us,” or “our”), whose address is 20, Glebe Road, Wickford, Essex, SS11 8EU, UNITED KINGDOM.

By accessing the Website or placing an order, you agree to these Terms. If you do not agree, do not use the Website or place an order. These Terms do not limit any rights that you have under applicable consumer law.

1. Eligibility and Website Use

1.1 Eligibility. You must be legally capable of entering into a binding contract to use the Website or place an order. If you use the Website on behalf of another person or an organization, you confirm that you have authority to bind them to these Terms.

1.2 Permitted use. You may use the Website only for lawful purposes and in accordance with these Terms. You must not misuse the Website, interfere with its operation or security, attempt unauthorized access, or use it to transmit unlawful, harmful, or fraudulent material.

3. Orders and Contract Formation

3.1 Placing an order. When you submit an order through the Website, you make an offer to purchase the selected products under these Terms. Please check your order details carefully before submission.

3.2 Order acceptance. An automated order confirmation acknowledges receipt of your order and does not, by itself, mean that we have accepted it. A contract is formed when we confirm that your order has been accepted or dispatch the products, whichever occurs first.

3.3 Refusal or cancellation. We may refuse or cancel an order before acceptance, including where a product is unavailable, information is materially incorrect, payment is not authorized, or we reasonably suspect fraud or misuse. If we cancel an order after payment, we will refund the amount paid for the affected order.

3.4 Order changes. Contact us promptly at sales@myfitstore.net if you need to request a change or cancellation. We cannot guarantee that a request can be accommodated once an order has entered processing or has been dispatched.

4. Prices and Payment

4.1 Currency and pricing. Prices displayed on the Website are in US dollars (USD), unless the Website clearly states otherwise. The total payable will be shown before you submit your order and will include any charges applicable to the order.

4.2 Payment. Payment must be made using a payment method offered at checkout. By submitting payment details, you confirm that you are authorized to use the selected payment method. Payment processing may be handled by a third-party provider and may be subject to that provider’s terms and privacy practices.

4.3 Pricing changes. Product prices may change at any time, but a change will not affect an order that we have already accepted, except where a material error requires us to contact you under Section 2.3.

4.4 Refunds. Where a refund is due under these Terms or applicable law, we will issue it using the original payment method unless we agree otherwise or the law requires another method. Processing times may depend on your payment provider.

5. Shipping, Delivery, and Import Charges

5.1 Delivery details. We will deliver products to the address supplied with your order. You are responsible for ensuring that the delivery information is complete and accurate. Delivery estimates are provided in good faith and are not guaranteed unless expressly stated otherwise.

5.2 DDP delivery. All orders are shipped Delivered Duty Paid (DDP). Fitstore pays all import duties, taxes, customs fees, and brokerage fees associated with delivery of your order. These charges will not be collected from you as a condition of delivery.

5.3 Delivery issues. If your order has not arrived within the stated delivery estimate, or arrives damaged or incomplete, contact us at sales@myfitstore.net with your order details. We will investigate and work with you to resolve the issue in accordance with applicable law.

5.4 Risk and ownership. Risk of loss or damage passes to you when the products are delivered to you or to a person you designate to receive them. Ownership passes when we have received full payment and the products have been delivered, subject to any rights you have under applicable law.

6. Returns, Refunds, and Exchanges

6.1 Return request period. You may request a return within 14 days from the date of delivery. To request a return, contact sales@myfitstore.net with your order number and the reason for the return. The return request must be made within that 14-day period.

6.2 Return authorization and instructions. We will provide instructions for returning an approved item. Please wait for those instructions before sending a product back. You must package the product securely and follow any reasonable return instructions we provide.

6.3 Condition of returned products. Unless a product is faulty, damaged, or incorrectly supplied, please return it unused and in its original packaging, with any included accessories and documentation. You may be responsible for any reduction in value caused by handling beyond what is necessary to assess the product’s nature, characteristics, and functioning, to the extent permitted by law.

6.4 Return costs. For a return that is not due to a product being faulty, damaged, or incorrectly supplied, you are responsible for the cost of returning the product unless we state otherwise. If the product is faulty, damaged, or incorrectly supplied, contact us so we can provide appropriate instructions and address the issue in accordance with applicable law.

6.5 Refunds and exchanges. Once we receive and assess an authorized return, we will notify you of the outcome. Approved refunds will be made to the original payment method, subject to applicable law and payment-provider processing times. Exchanges are subject to product availability.

7. Promotions and Discount Codes

7.1 Promotional terms. Promotions and discount codes may be subject to separate terms, including eligibility, duration, and product exclusions. Those terms will apply in addition to these Terms.

7.2 Use of codes. Unless expressly stated otherwise, a discount code must be entered at checkout, cannot be applied after an order is accepted, and cannot be exchanged for cash or combined with another offer.

7.3 Errors and misuse. We may withdraw or correct a promotion where there has been an error, misuse, or suspected fraud. Any action taken will be subject to applicable law.

13.3 Consumer use. If you are a consumer, this Section does not affect your statutory rights or any remedy available to you under applicable consumer law.

14. Indemnity

To the extent permitted by law, you agree to compensate Fitstore Ltd for losses, liabilities, and reasonable costs arising directly from your unlawful use of the Website, your breach of these Terms, or your infringement of another person’s rights. This Section does not apply to the extent a loss was caused by our own breach, negligence, or other conduct for which liability cannot lawfully be excluded.

15. Suspension and Termination

We may suspend or restrict access to the Website, or terminate an account, where reasonably necessary for security, legal, or operational reasons, or where we reasonably believe these Terms have been breached. Any such action will not affect rights or obligations that arose before suspension or termination and will be subject to applicable law.
